Article 1 — Purpose and Scope

The Website ts-immo.ch provides access to: real estate data gateway services, CRM migration, contact management, and delegated service management for real estate professionals. The Website is exclusively intended for professional (B2B) use. Ts-Services grants a limited, revocable, non-exclusive and non-transferable right of access to the Services.

Article 2 — Access

Access is reserved for professionals. Ts-Services may suspend or deny access without prior notice for breach of these Terms. An internet connection and up-to-date browser are required at the User's expense.

Article 3 — Registration and Account

Users must provide accurate, truthful information. Users are responsible for credential confidentiality. Account deletion requests: support@ts-immo.org. Inactive accounts deleted after 36 months.

Article 4 — Availability

Ts-Services takes reasonable steps to ensure continuous access but may suspend service for maintenance, security or force majeure without compensation.

Article 5 — User Obligations

Users must not: transmit unlawful content; infringe intellectual property; create unauthorised links; use data for competing purposes; engage in reverse engineering or automated scraping; attempt to compromise system security; transmit malware.

Users are solely responsible for content they transmit and warrant they hold all necessary rights thereto.

Article 6 — Intellectual Property

All Website content is the exclusive property of Ts-Services, protected under French and Swiss law. Reproduction without prior written consent is strictly prohibited.

Article 7 — Personal Data

Data processing is governed by the Privacy Policy on ts-immo.ch, compliant with the Swiss FADP and GDPR. Rights exercisable at rgpd@ts-immo.org within 30 days.

Article 8 — Liability

Ts-Services' liability does not extend to indirect damages, maintenance interruptions or force majeure events. Liability is limited to direct damages as set out in the GTC.

Article 9 — Evidence

Ts-Services' computer systems constitute evidence between the parties in any legal proceedings.

Article 10 — Severability

Invalidity of any provision does not affect the remaining provisions.

Article 11 — Governing Law and Jurisdiction

These Terms are governed by French law. Users domiciled in Switzerland benefit from mandatory Swiss law protections. Disputes are submitted to the Commercial Court of Thonon-les-Bains; Swiss users may also access Swiss cantonal courts for matters governed exclusively by mandatory Swiss law.

Article 12 — Amendments

These Terms may be amended at any time with notice to registered users. Continued use constitutes acceptance.
